Thank you for using Quick Evict Utah for your eviction related services.  We appreciate your business.  This Fee Agreement (“Agreement”) spells out the terms of the legal services we will provide.  By clicking “I have read and agree to the Terms and Conditions” below you agree to the terms of this Agreement and to our Terms and Conditions as disclosed on our website and in the preceding link.

Limited Scope Representation

We agree to represent you regarding the specific legal services that you request in submitting this form, and only those services specifically requested.  Unless our services are previously terminated, or you have ordered a money judgment in advance, our representation will terminate upon our obtaining an Order of Restitution granting you possession of the property or upon the tenants otherwise voluntarily vacating the property.  In the event you do not order a default money  judgment in advance, but wish to have us obtain one for you, you may order a default money judgment and we will provide the necessary services to obtain the judgment. We reserve the right to withdraw from the case following the conclusion of the limited scope of our representation.

Services included in 3-Day Notice to Vacate and Letter

If this service is selected alone, we will post an initial notice (or multiple notices, if more than one is selected) on the premises.  If this service alone is selected, we will not provide any other services including legal action against the tenant.

Services Included in Uncontested Eviction

The services provided in the Uncontested Eviction service are limited to the following:

  1. Prepare and have served on the defaulting tenant a Summons and Complaint for unlawful detainer and money damages due for the relief sought based on the information you entered when you placed your order and in any subsequent discussions with QEU.
  2. File the Summons and Complaint described above in the court that meets the appropriate jurisdictional requirements in the State of Utah.
  3. Prepare and file all the necessary documents to obtain a default judgment against the defaulting tenant.
  4. Obtain an Order of Restitution from the court enforceable by a Sheriff or Constable, requiring the defaulting tenant to vacate the property.

Contested Eviction

In the event any tenant files an Answer to the Complaint in your case we will, for a fee of $150, schedule and attend an Immediate Occupancy Hearing on your behalf.  An Order of Restitution granting you possession of your property is generally granted by the Judge at the Occupancy Hearing or shortly thereafter.  In the unlikely event the tenant does wish to contest the eviction further and posts a possession bond with the court making further legal proceedings necessary we will discuss with what further action and fees may be necessary.

Collections Efforts

Although we do provide these services and we may agree to in the future, we are not agreeing to pursue collections efforts against the defaulting tenant at this time.

Payment for Services Requested

The flat fee payment that you pay for the services requested is payment for services rendered, is deemed earned upon receipt and is not considered a retainer.

Representations and Warranties

You represent and warrant that the information you provide in the Order Form is true and correct.  You understand that QEU is relying on the information provided to carry out the services you requested including initiating and pursuing legal action.  You agree to indemnify and hold harmless QEU and its attorneys for any damages or cause of action attributable to any false or misleading information you provide when you placed your order or in subsequent discussions with QEU.


The laws of the State of Utah shall govern the construction, interpretation, and enforcement of this Agreement.  This Agreement contains the entire agreement of the parties hereto with respect to the subject matter hereof, and no modification or waiver of any provision hereof shall be valid unless it is in writing and signed by all parties.

We will not commence work on your behalf until this agreement has been accepted and payment has been received.  Upon receipt of those items, we will begin work on your case and will pursue all necessary actions with reasonable diligence.  We very much appreciate the opportunity to be of service in this important matter, and will exercise our best efforts, consistent with all practical considerations, to accomplish the work effectively and efficiently.  Please contact us with any questions or concerns you have regarding this Agreement.
